Ramey & Schwaller Obtains Appeal Win at Patent Trial and Appeal Board

Ramey & Schwaller filed an appeal to the Patent Trial and Appeal Board (PTAB) for Northern Therapeutics, Inc. regarding the rejection of claims 17 and 40 of United States Patent Application Serial Number 11/696,039 by the United States Patent and Trademark Office (USPTO). The PTAB issued its decision reversing the USPTO on July 20, 2016, finding that claims 17 and 40 are enabled by the specification.

Congratulations to Custom Medical Applications

Ramey & Schwaller wishes to congratulate its client Custom Medical Applications on issuance of U.S. Patent Number 9,131,960 titled Safety Neural Injection System and Related Methods on September 15, 2015. The safety neural injection system comprises a cannula with an open distal end, rigid bend and a side port.  The safety neural injection system also comprises a flexible stylet with a shaped tip.

Schwaller Article in AIPLA Patent Law Committee Newsletter

Melissa Schwaller’s article titled “Effect of the Date of the First Use in Commerce on Patent Validity Under the On Sale Bar/Public Use Bar” appeared in the October 2015 American Intellectual Property Law Association’s Patent Law Committee Newsletter. The article discusses whether the date listed for the first use in commerce in a trademark application that is earlier than one year before the filing of the patent application affects the validity of the patent under the on sale bar/public use bar on a good or service covered by the mark and patent claims.

Ramey & Browning files suit against Invention Resource International and Patent Attorney

Ramey & Browning filed suit against Invention Resource International and patent attorney Emery Tracy on January 27, 2015 on behalf of firm client Eddie Jenkins alleging violation of the Texas Invention Development Services Act, breach of fiduciary duty, malpractice, fraud, and breach of contract.  The suit also alleges that the contract’s arbitration clause is unenforceable.  Attorneys on the case are William P. Ramey, III and Melissa D. Schwaller.
